Marketing & Ethics Compliance Manager (Wine Jobs: Sales & Marketing)

1) Position Summary:

The Marketing & Ethics Compliance Manager will:

- Review advertising and marketing programming (e.g., social media brand pages and posts, rebates, sweepstakes, and other promotions) for compliance with all federal and state trade practice, marketing and intellectual property laws, and other regulations applicable to the marketing of alcohol beverage products in the US.

 - Support and advance the Company’s ethics and compliance program by assisting in developing annual training plans; selecting or developing courses to train on various aspects of Code of Conduct and ensuring appropriate completion by employees ; coordinating regular communication with the Company’s Ethics Ambassadors; training and fielding questions on compliance policies such as conflicts of interest and gifts and hospitality; drafting the ethics and compliance newsletter; drafting ethics and compliance policies and educational communications; managing the conflict of interest disclosure process; managing the gifts database; and providing educational communications regarding outcomes to ethics investigations.

 

2) Major Responsibilities / Accountabilities: Approximate % of Time:

 

1. Review of marketing materials for brand campaigns, as well as on-premise and off-premise activations to ensure compliance with Federal & State alcohol beverage laws, intellectual property laws, marketing and advertising laws, and DISCUS and Company guidelines. Assist with legal training. Prepare rules and analyze programming for sweepstakes and contests.

2. Draft sponsorship, events, and other simple marketing related agreements.

3. Conflict of Interest/Gifts - Manage annual conflict of interest disclosure process, ensuring proper follow-up to any disclosures and implementation of measures to address actual and/or potential conflicts. Facilitate disclosure of potential conflicts of interest at other points during the year. Respond to questions regarding PR USA Gifts & Hospitality Policy, and maintain database of gifts and hospitality approved above nominal value.

4. Ethics communication – Coordinate communication with Company’s Ethics Ambassadors. Draft and communicate "clean" examples where Company has discovered and addressed ethical issues for educational purposes. Communicate/educate regarding answers to frequently asked ethics questions. Draft Ethics and Compliance newsletter.

5. Ethics/Code training – Develop annual training plan. Manage online training database and ensureethics/Code training is launched and completed by employees in a timely manner. Draft and or select online training programs.

3) Nature & Scope:

  This employee will be handling sensitive information regarding our products and marketing programs, both internally and externally. Positive interaction and support with various members of the Marketing and Sales Departments, and interaction with employees with ethics questions is necessary to achieve business commitments and maintain brand strategy. Must be able to conduct efficient legal review and decision making while consulting with counsel for more complex marketing compliance issues if appropriate. The employee will also be working with attorneys and state regulatory personnel.

 

4) Requirements:

a. Education: College Degree (4 year), Graduate Degree preferred.

b. Experience / Background: At least 3-6 years experience working in a compliance environment in a corporate setting or law firm required. Experience in ethics and strongly preferred. Familiarity advertising, intellectual property and/or state alcohol beverage laws also preferred.
